The Hubs and I are probably the most patient people on the planet, but we're slowly losing it with our builder. If you've hung around here long enough, you'll remember that we signed a purchase and sale agreement on a new construction home back in October.

Lessee... it's almost June, right? According to our agreement, the house was supposed to be finished the end of June.

How does she find time to blog and work when she has to pack, you might be asking? Here's how... It's still in the permit stage. The plans keep getting turned down by the city.

The cost of housing has been really going crazy around here and every time The Hubs suggests that we back out of the deal, I mention that this is THE perfect house, in THE perfect neighborhood, on THE perfect lot. It's worth the wait.

Patience, Grasshopper.

Today we got word that the plans were turned down again almost three weeks ago and the builder still hasn't resubmitted them so The Hubs got frustrated and started looking for other housing options.

He entered his criterion into the multiple listing search and guess what? Our unbuilt house showed up listing at almost 30,000 more than we paid for it. It's perfectly legal for him to keep it on the market in case we can't follow through with the purchase, so that's not in question.

I've had a sneaking suspicion that he's been stalling on purpose, hoping to make more money on the place and hoping that we'll back out of the deal from sheer frustration. Now I'm beyond suspicious.

As far as I know, he's locked into the deal until we back out. But at what point do we quit playing cat and mouse? Before we found this place, we planned to buy a house and move in the Spring, but this house just kind of appeared out of nowhere and it was perfect for us. Spring has sprung. Now we're heading toward Summer.

This house is worth the wait, if it indeeds comes to fruition. But how long do we wait? What if the plans never get approved because of the unique features of the property?

Oh, how I wish I had a crystal ball.

If you have a contract and there is a dispute, you need to speak to a lawyer versed in real estate law. Even if the builder IS holding out for more money, if he has a contract with you, he's in for some serious legal trouble if he doesn't deliver and soon! For one thing, the plans he claims to be submitting to the City should have been approved long before you even signed a contract. See what you can do along the lines of free inquiries and find out what your legal stance is. You've waited long enough.

We are building a new home too, and the builders are SO frustrating. Our issues have involved them not actually listening to what we say, and adding things to our tender we didn't actually ask for.
The council approvals have been the easy part (unusually).
